1. Who we are

These Terms and Conditions govern your purchase of a vehicle from us. Please read them carefully before completing your purchase.

We are GAV Trading Limited, trading as Gavrix Motors, registered in England and Wales under company number 15717069. Our registered office is at 1 Beaufort Gardens, London, NW4 3QN. You can contact us at sales@gavrixmotors.co.uk.

We are registered with the Information Commissioner's Office (ICO) as a data controller.

2. These terms

These Terms and Conditions, together with our Privacy Policy, form the agreement between you and us when you purchase a vehicle. By submitting the customer registration form and completing payment, you confirm that you have read and agree to these terms.

You must be 18 years of age or over to purchase a vehicle from us. If you are under 18, you may not place an order.

3. Authorised collection and service partners

Your contract of sale is with GAV Trading Limited t/a Gavrix Motors. Where you collect your vehicle from an authorised Gavrix Motors dealer or workshop, that dealer or workshop acts as an authorised collection and service partner only. They are not a party to the contract of sale, and Gavrix Motors remains solely responsible for your vehicle purchase, warranty, and any statutory rights arising from the sale.

4. Formation of contract

Submitting the customer registration form does not constitute a binding contract. A contract between you and us is only formed when we have issued a sales invoice and received cleared funds in full. We reserve the right to decline an order at any time before this point, in which case we will notify you promptly and no charge will be made. Where a vehicle becomes unavailable after receipt of your registration form but before a contract is formed, we will notify you promptly and no charge will be made. Upon receipt of your registration form, we will send you an acknowledgement by email in accordance with the Electronic Commerce (EC Directive) Regulations 2002. This acknowledgement does not constitute acceptance of your order or formation of a contract.

5. Price and payment

The total price payable consists of the vehicle price and the on-the-road (OTR) charge of £99, which covers DVLA registration and vehicle tax. Both are shown as separate line items on your sales invoice.

The following are not included in the price and are your responsibility to arrange:

  • Motor insurance

  • L-plates

  • Any other accessories or equipment not described as included in the sale

Payment must be made in full in accordance with the payment instructions on your sales invoice. Title to the vehicle does not pass to you until we have received cleared funds in full.

In the event that a price is displayed incorrectly on our website or in any communication due to a technical or administrative error, we reserve the right to cancel the order and issue a full refund. We will notify you as soon as we become aware of any such error. Risk in the vehicle passes to you upon collection from the authorised Gavrix Motors dealer or workshop.

GAV Trading Limited is a VAT-registered business. VAT at the current standard rate of 20% is charged on all vehicle sales and will be shown on your sales invoice, together with our VAT registration number.

6. DVLA registration

As part of the purchase process, we will register and tax the vehicle with the DVLA on your behalf under the Vehicle Excise and Registration Act 1994. To do this, we require your name, address, date of birth, and contact details as provided on the customer registration form.

Your V5C logbook will be sent directly to your registered address by the DVLA. You will be the registered keeper of the vehicle from the point of registration.

We will provide you with your licence plate number by email once registration is complete, so that you can arrange motor insurance before collecting the vehicle.

7. Collection

We aim to make your vehicle available for collection from the authorised Gavrix Motors dealer or workshop at which you viewed or selected it by the end of the next business day following receipt of cleared funds in full, subject to completion of DVLA registration. Collection times are estimates and may be subject to change due to operational or administrative factors outside our control. We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control.

At the point of collection, you must:

  • Present a valid form of photo ID. The name on your ID must match the name provided on your customer registration form exactly. We reserve the right to refuse release of the vehicle if satisfactory ID cannot be produced; and

  • Confirm that you hold valid motor insurance for the vehicle.

The authorised dealer or workshop will stamp and sign your User Manual or Maintenance Booklet at handover. This activates your warranty. Please read your User Manual or Maintenance Booklet carefully and keep it safe - it is required to maintain your warranty and must remain with the vehicle at all times.

You are responsible for inspecting the vehicle carefully at the point of collection. If you notice any visible damage or defect at collection, you must raise this with the authorised dealer or workshop before leaving and notify us in writing at sales@gavrixmotors.co.uk within 48 hours of collection. Failure to notify us within this period may affect your ability to make a claim in respect of damage or defects that were reasonably apparent at the time of collection.

8. Your right to cancel

As this is a distance contract concluded online, you have the right to cancel your order within 14 days without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The 14-day cancellation period begins on the day you, or a third party nominated by you, take physical possession of the vehicle.

To exercise your right to cancel, you must notify us clearly before the 14-day period expires by contacting us at sales@gavrixmotors.co.uk.

If you expressly request that we register the vehicle with the DVLA before the end of the 14-day cancellation period - which you do by ticking the relevant box on our registration form - you acknowledge that the vehicle will be registered in your name and that this may reduce its resale value. If you cancel within 14 days of collection, you must return the vehicle to us at your own cost without undue delay and in any event within 14 days of notifying us of your decision to cancel. You must take reasonable care of the vehicle while it is in your possession. We may make a reasonable deduction from your refund to reflect any reduction in the vehicle's market value resulting from that registration at your request, in addition to any reduction for use, mileage, or damage. Any such deduction will be based on the actual reduction in market value and calculated on a reasonable basis.

If you cancel and are entitled to a refund, we will issue it using the same payment method within 14 days of receiving the returned vehicle, or within 14 days of receiving your cancellation notice if no return is required.

9. Warranty

Your vehicle comes with a 2-year or 10,000 km (approximately 6,214 miles) parts warranty against manufacturing and material defects from the date of first sale, whichever comes first. Full details of the warranty conditions, exclusions, and claims process are set out in the Gavrix Motors User Manual or Maintenance Booklet provided with your vehicle. All Gavrix Motors vehicles are UK Type Approved and comply with applicable UK road vehicle regulations.

In summary:

  • The warranty covers the cost of replacement parts only. Labour, diagnostic, and associated costs are not included and remain your responsibility.

  • The warranty applies only where the vehicle has been serviced in accordance with the service schedule in the User Manual or Maintenance Booklet by an authorised Gavrix Motors dealer or workshop, using appropriate fluids and genuine parts, with each service confirmed by a stamp and signature in the User Manual or Maintenance Booklet. Warranty claims may not be accepted without a complete stamped service history.

  • The warranty does not cover consumables, wear parts, accidental damage, misuse, damage from external causes, or vehicles used for commercial purposes including delivery, courier, rental, or fleet operations. Full exclusions are listed in the User Manual or Maintenance Booklet.

  • Warranty rights transfer to subsequent owners provided the conditions of the warranty have been met. You must pass the Gavrix Motors User Manual or Maintenance Booklet to any subsequent owner of the vehicle. Failure to do so may invalidate the warranty for that owner.

To make a warranty claim, take your vehicle to the authorised Gavrix Motors dealer or workshop from which you purchased it. For any warranty queries, contact us at warranty@gavrixmotors.co.uk.

This warranty is in addition to and does not affect your statutory rights under the Consumer Rights Act 2015.

10. Product safety and recalls

If we become aware of a safety issue or recall affecting your vehicle, we may contact you using the details you have provided to notify you and arrange any necessary inspection, repair, or replacement. You agree to provide accurate contact details and to notify us of any changes where reasonably necessary for safety-related communications.

11. Your statutory rights

Nothing in these Terms and Conditions affects your statutory rights as a consumer. Under the Consumer Rights Act 2015, you have the right to expect that goods are of satisfactory quality, fit for purpose, and as described. If your vehicle does not meet these standards, you may be entitled to a repair, replacement, or refund depending on the circumstances and timing of the fault.

12. Your responsibilities

You are responsible for ensuring that, before riding your vehicle on a public road, you:​

  • Have arranged valid motor insurance for the vehicle;

  • Are at least 16 years old and hold appropriate training or a valid licence for the vehicle (CBT, A1 licence, or full A licence, as applicable);

  • Display L-plates if you are riding on a CBT;

  • Check that a licence plate is correctly fitted to the vehicle before riding on a public road;

  • Comply with all applicable road traffic laws at all times; and

  • Provide accurate and truthful personal information at all times. We reserve the right to cancel any order or refuse to release a vehicle where we reasonably suspect fraud, misrepresentation, or identity mismatch.

Gavrix Motors cannot be held responsible for any consequences arising from your failure to comply with these requirements, or from the installation of non-approved parts or modifications made by a third party.

13. Our liability

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights under the Consumer Rights Act 2015.

Subject to the above, we are not liable for any indirect or consequential losses arising from your purchase, including loss of income, loss of use of the vehicle, or costs arising from the vehicle being off the road. Our total liability to you in connection with any purchase shall not exceed the total price you paid for that vehicle.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, extreme weather, pandemic, strike, civil unrest, failure of third-party systems or suppliers, or regulatory action. Where such circumstances cause a material delay, we will notify you promptly. If the delay continues for more than 30 days, you may cancel your order and receive a full refund of any sums paid.

15. Complaints and alternative dispute resolution

If you have a complaint, please contact us in the first instance at sales@gavrixmotors.co.uk. We will acknowledge your complaint promptly and aim to resolve it within 14 days.

If we are unable to resolve your complaint to your satisfaction, you may seek to resolve the dispute through Alternative Dispute Resolution (ADR). ADR is a process by which an independent third party helps to resolve disputes without going to court. We are not currently a member of an approved ADR scheme, but we will consider using one where appropriate and will always try to resolve complaints directly and fairly. 16. Intellectual property

All content on our website, including text, images, logos, and branding, is owned by or licensed to GAV Trading Limited. You may not reproduce, distribute, or use any content from our website without our prior written consent.

17. Governing law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Changes to these terms

We may update these Terms and Conditions from time to time. The version in force at the time you place your order will apply to your purchase. We encourage you to review these terms before purchasing.

19. Notices

Any notice or communication required or permitted under these Terms and Conditions must be sent by email to sales@gavrixmotors.co.uk. Notices sent by email are deemed received on the next business day following transmission, provided no delivery failure notification is received.
