This Privacy Policy explains how we collect and use your personal information when you interact with us, including when you visit our website at www.gavrixmotors.co.uk, submit an enquiry, or complete our customer registration form to purchase a vehicle.

For the purposes of UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, we are the data controller of the personal information we collect and use. We are registered with the Information Commissioner's Office (ICO) as a data controller.

2. The information we collect

We may collect and process the following types of personal information:

  • Identity details - your first name, last name, and date of birth.

  • Contact details - your email address and phone number.

  • Address details - your full residential address, including postcode.

  • Vehicle details - the scooter model you are purchasing.

  • Enquiry details - information you include in free-text fields when you contact us.

  • Technical data - IP address, browser type, device information and similar data collected automatically when you use the website through cookies and similar technologies.

We do not intentionally collect special category data (such as health information) or children's data. Please do not include such information when you contact us.

3. How we collect your information

We collect personal information when you:

  • Complete the customer registration form on our website in connection with a vehicle purchase.

  • Contact us by email, phone, or other contact method shown on the website.

  • Interact with the website, where some technical data may be collected automatically through cookies and similar technologies.

4. How we use your information and our legal bases

Vehicle registration and purchase processing

When you purchase a vehicle through one of our authorised dealers, we use your name, address, date of birth, and contact details to:

  • Register and tax the vehicle with the DVLA on your behalf, in accordance with the Vehicle Excise and Registration Act 1994 and the Road Vehicles (Registration and Licensing) Regulations 2002;

  • Process and retain transaction records for VAT compliance purposes in accordance with our obligations under the Value Added Tax Act 1994;

  • Issue your sales invoice and manage payment;

  • Notify you of your licence plate number so you can arrange motor insurance before collection; and

  • Share your name with the authorised dealer or workshop from which you are collecting the vehicle, solely for the purpose of verifying your identity against your photo ID at the point of collection.

Legal basis: performance of a contract to which you are a party, and compliance with our legal obligations under vehicle registration legislation.

Responding to enquiries: To respond to questions or requests you send us.

Legal basis: our legitimate interests in running and promoting our business.

Operating and improving our website: To operate, maintain, and improve the website, including using technical data to understand how it is used and to keep it secure.

Legal basis: our legitimate interests in keeping the website secure and improving how we present information. For non-essential cookies and analytics, we rely on your consent where required by law.

We do not currently operate marketing lists or send marketing newsletters. If this changes, we will update this Policy and, where required, ask for your consent.

5. Who we share your information with:

  • Authorised dealers and workshops: Where you collect a vehicle at one of our authorised dealers/workshops, we will share your name with them solely for the purpose of verifying your identity at the point of vehicle collection. We do not share your address, date of birth, financial details, or any other personal information with dealers unless legally required to do so. Dealers/workshops are required under our agreements with them to handle any personal information they receive in compliance with UK GDPR and the Data Protection Act 2018, and to use it only for the purpose for which it was shared.

  • DVLA: We submit your personal information to the DVLA as part of the vehicle registration process. This is a legal requirement under the Vehicle Excise and Registration Act 1994. The DVLA will send your V5C logbook directly to your registered address.

  • Service providers: Companies that provide services to us such as website hosting, email services, and IT support. These providers process information on our behalf and are bound by appropriate data processing agreements.

  • Professional advisers and authorities: Our accountants, legal advisers, regulators, or law enforcement where necessary to comply with applicable law or to protect our rights.

We do not sell your personal information.

6. International transfers

Some of our service providers, including our website platform provider Wix, may transfer or store personal information outside the UK. Where this happens, we ensure that appropriate safeguards are in place, such as standard contractual clauses approved by the ICO or reliance on an adequacy regulation, so that your information continues to be protected to the standard required by UK GDPR.

7. How long we keep your information

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy and to meet our legal obligations.

  • Purchase and registration records: up to 6 years from the date of sale, in accordance with the Limitation Act 1980 and our obligations under consumer protection and tax legislation.

  • Enquiry and contact records: up to 2 years after our last meaningful contact with you.

We may retain limited customer contact details and vehicle identification information (including VIN) for longer where necessary to comply with product safety obligations, including contacting you in the event of a safety recall.

8. Your rights

Under UK GDPR and the Data Protection Act 2018, you have the following rights in relation to your personal information, subject to certain legal conditions:

  • Right of access - to obtain a copy of your personal data and information about how we use it.

  • Right to rectification - to have inaccurate or incomplete data corrected.

  • Right to erasure - to ask us to delete your data in certain circumstances.

  • Right to restrict processing - to limit how we use your data in certain situations.

  • Right to object - to object to processing where we rely on legitimate interests.

  • Right to data portability - in some circumstances, to receive your data in a structured, commonly used, and machine-readable format.

  • Rights related to automated decision-making - not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects.

Data breaches: In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the ICO within 72 hours and, where required, notify you without undue delay.

9. Cookies and similar technologies

Our website may use cookies and similar technologies to make the website function correctly, remember your preferences, and help us understand how the website is used. Where required by the Privacy and Electronic Communications Regulations 2003 (PECR) and UK GDPR, we will ask for your consent before setting (accepting or rejecting) non-essential cookies.
